Welcome to CBMO AI Marketing Platform ("CBMO," “cbmo.ai,” "we," "our," or "us"), owned and operated by BOEIZ FZE, United Arab Emirates. By accessing or using our website, platform, or services (collectively, the “Services”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read them carefully. If you do not agree with these Terms, do not use our Services.

1. Eligibility

You must be at least 18 years old to use CBMO. By using the Services, you confirm that you have the legal capacity to enter into these Terms.

2. Account Registration

2.1 To access certain features, you must register for an account.

2.2 You agree to provide accurate, current, and complete information during registration and maintain its accuracy.

2.3 You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.

2.4 You must notify us immediately of any unauthorized use of your account.

3. Use of the Services

3.1 You agree to use the Services only for lawful purposes and in accordance with these Terms.

3.2 You may not:

• Violate applicable laws or regulations.
• Infringe any third-party rights.
• Interfere with or disrupt the Services or servers.
• Attempt to gain unauthorized access to our Services, accounts, or systems.

4. Intellectual Property

4.1 All content, features, and technology provided by CBMO — including but not limited to the platform, software, algorithms, tools, user interface, graphics, designs, and logos — are owned by CBMO or its licensors and protected by copyright, trademark, and other applicable laws.

4.2 This ownership does not extend to AI-generated outputs (as defined in the “AI-Generated Outputs” section), which remain the property of the user subject to these Terms.

4.3 You may not copy, modify, distribute, sell, or lease any part of our Services, except as expressly permitted in these Terms or with prior written permission from CBMO.

5. AI-Generated Output

5.1 Ownership of Outputs

All outputs generated by users through CBMO’s platform (including but not limited to images, social media posts, blogs, articles, website copy, press releases, marketing materials, and creative copy), using third-party artificial intelligence (“AI”) models under the creative direction of the user, are deemed to be owned by the user. Subject to compliance with these Terms, users may use such outputs for personal, commercial, or campaign purposes. CBMO does not claim ownership over such AI-generated outputs.

5.2 License to CBMO and Service Providers

By generating outputs on the platform, users grant CBMO and its third-party AI service providers a non-exclusive, worldwide, royalty-free license to process, store, and display such outputs solely for the purposes of operating, maintaining, improving, and securing the platform.

5.3 User Responsibility

Users are solely responsible for the prompts, data, and instructions they provide and the outputs generated. Users must ensure that their use of AI-generated outputs complies with all applicable laws and does not infringe upon the intellectual property, publicity, or other rights of any third party.

5.4 Accuracy, Originality, and Reliability Disclaimer

AI-generated outputs may contain inaccuracies, omissions, unintended bias, or elements similar to existing works. CBMO makes no representation or warranty regarding the accuracy, completeness, originality, copyright eligibility, or legal compliance of such outputs. Users should independently review and verify AI-generated outputs before publishing, distributing, or relying upon them.

5.5 Prohibited Use

Users may not use AI-generated outputs for unlawful, defamatory, misleading, harmful, discriminatory, or otherwise prohibited purposes, or in any way that violates these Terms.

6. Payments

6.1 Payments for Starter and Growth plans are processed via Stripe. We will not store or collect your payment card details. That information is provided directly to our third-party payment processor whose use of your personal information is governed by their Privacy Policy.
These payment processors adhere to PCI-DSS standards as managed by the PCI Security Standards Council (Visa, Mastercard, American Express, Discover). PCI-DSS requirements help ensure the secure handling of payment information.

6.2 You agree to provide valid payment details and authorize CBMO to charge the applicable fees.

6.3 All fees are non-refundable unless required by law or expressly stated in our refund policy.

7. Cookies and Tracking

CBMO uses cookies and similar technologies to improve your experience. By using our Services, you consent to our use of cookies in accordance with our Cookie Policy.

8. Privacy

Your use of CBMO is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

9. Termination

9.1 CBMO may suspend or terminate your access at any time, without notice, if you violate these Terms or for any other reason permitted by law.

9.2 Upon termination, your right to access the Services ceases immediately.

10. Disclaimers

10.1 CBMO provides the Services “as is” and “as available.”

10.2 We disclaim all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, CBMO shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services.

12. Indemnification

You agree to indemnify and hold CBMO, its affiliates, and employees harmless from any claims, liabilities, damages, losses, or expenses arising from:

• Your use of the Services;
• Violation of these Terms; or
• Violation of any applicable law or third-party rights.

13. Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of the UAE.

14. Changes to Terms

CBMO may update these Terms from time to time. Updated Terms will be posted on the platform with the “Last Updated” date. Your continued use of the Services constitutes acceptance of the revised Terms.
